1. Introductory Provisions

1.1. Subject and Purpose of the General Terms and Conditions (hereinafter "GTC")

These GTC regulate the legal relationships between Finance Masters a.s., with its registered office at Vojtěšská 211/6, Nové Město, 110 00 Prague 1, ID No.: 141 60 960 (hereinafter "Provider" or "Company"), and individuals or legal entities (hereinafter "Customer" or "Client") using the Provider's services through the Y4trade.com web platform (hereinafter "Platform").

1.2. Consent to the GTC

By registering on the Platform or using the services, the Customer unconditionally agrees to these GTC. If the Customer does not agree with any part of these terms, they must not use the Provider's services.

1.3. Age Limit and Eligibility

The services are only available to individuals over 18 years of age who are fully capable of making legal transactions. By registering, the Customer confirms that they meet this condition. The Provider reserves the right to verify the Customer's age at any time.

1.4. Service Restrictions

The services are not intended for individuals who are citizens of or have permanent residence in jurisdictions where the provision of such services is prohibited or restricted. The Provider does not offer services to entities listed on international sanctions lists.

1.5. Jurisdiction

These GTC are governed by the laws of the Czech Republic.

2. Definitions

  • Provider: Finance Masters a.s., which provides services in the field of trading on financial markets.
  • Customer/Client: Any individual or legal entity who opens an account on the Platform.
  • Services: All products and services offered by the Provider, including prop trading, analytical tools, educational programs, and support.
  • Account: The Customer's personalized access to the Platform for trading purposes.
  • Platform: The online system Y4trade.com providing access to trading tools.
  • Trading Strategy: A set of rules and techniques that the Customer uses to execute trades.

3. Services and Ordering

3.1. Description of Services

The Provider offers:

  • Simulated trading (demo accounts): For training and testing trading strategies.
  • Prop trading accounts: The Customer trades with the Provider's capital under specific conditions.
  • Educational services: Webinars, courses, and analytical tools.

3.2. Ordering Services

The Customer orders services via the online form on the Platform. After submitting the form and making the payment, the order will be processed.

3.3. Responsibility for Data

The Customer is required to provide truthful, accurate, and up-to-date data. The Provider is not responsible for damages caused by incorrect data.

3.4. Service Changes

The Provider reserves the right to change the service offering at any time. The Customer will be informed of such changes in advance.

4. Payment Terms

4.1. Prices and Fees

All fees are listed on the platform and are expressed in dollars (USD), unless otherwise stated. Prices may be adjusted depending on market conditions.

4.2. Payment Methods

  • Credit Cards (VISA, MasterCard)
  • Bank Transfer
  • E-wallets (Skrill, PayPal, etc.)

4.3. Refund Policy

Fees are non-refundable unless otherwise agreed. Exceptions may be made in case of technical errors or unauthorized payments.

5. Trading Rules

5.1. Demo Trading

Trading on a demo account is for educational purposes only. Profits or losses on a demo account are not real.

5.2. Prop Trading Accounts

The Customer can trade with the Provider's allocated capital after meeting specified conditions (e.g., successfully completing a trading challenge).

5.3. Prohibited Trading Practices

  • Exploiting system errors
  • Market manipulation trading
  • Copying trades from other traders without consent

5.4. Consequences of Violating the Rules

Violation of the rules may result in:

  • Immediate account cancellation
  • Loss of access to allocated capital
  • Legal action against the Customer

6. Personal Data Protection

6.1. Privacy Policy

The Provider processes personal data in accordance with GDPR. The data is protected from unauthorized access.

6.2. Purposes of Processing

  • Account registration and management
  • Marketing activities (with the Customer's consent)
  • Compliance with legal obligations

6.3. Customer Rights

  • Right to access data
  • Right to correct or erase data
  • Right to data portability

7. Liability and Limitation of Liability

7.1. The Provider is not responsible for any losses caused by:

  • Technical errors on the Platform
  • Adverse market conditions
  • Incorrect use of trading strategies by the Customer

7.2. Force Majeure

The Provider is not liable for service failures due to events beyond its control (natural disasters, wars, pandemics, etc.).

8. Termination of the Agreement

8.1. The agreement may be terminated:

  • By the Customer: By sending a written notice to the Provider’s email.
  • By the Provider: In the event of a violation of the GTC or legal regulations.

8.2. Upon termination of the agreement, the Customer loses access to all services.

9. Changes to the Terms and Conditions

9.1. The Provider may modify these GTC at any time. The Customer will be informed of changes via email or through the Platform.

9.2. By continuing to use the services after the changes take effect, the Customer agrees to the new terms.

10. Dispute Resolution

10.1. All disputes will be resolved by mutual agreement.

10.2. If a dispute cannot be resolved amicably, it will be decided by the competent court in accordance with the laws of the Czech Republic.

11. Final Provisions

11.1. These GTC take effect on the date of their publication on the Provider's website.

11.2. If any provision becomes invalid, the remaining provisions remain valid.
